Employers shall report to the National Institute for Prevention, Health and Safety at Work, the occupational diseases and accidents and any other pathological conditions established by law that may occur in the workplace and shall keep a record of them.
The OSH system shall be composed by members of the following agencies:.
The crime of manslaughter is provided for in the Criminal Code. Employers shall take the adequate measures so as to prevent any kind of sexual harassment and establish a policy in view of eliminating it. This information shall be provided in a manner that will ensure respect for confidentiality and trade secrets.
According to the law, unsafe and unhealthy conditions are all those conditions under which the employer does not guarantee workers the elements of basic sanitation, including drinking water, bathrooms, toilets, changing rooms and the necessary conditions for taking meals, among others. The employer shall report the occupational accident or disease to the National OSH Institute, the OSH Committee and the workers’ union, 24 hours after the accident occurred or the disease was diagnosed.

The manufacturers, importers and suppliers of machinery, equipment, products and equipment are required to ensure that these are not a source of danger to the worker, when used in the recommended conditions and manner. Delegates on prevention OSH issues, coveinn elected according to the law, shall represent the workers at the committee on safety and health at work.
The OSH Services shall be comprised of professionals from different disciplines in the area of safety and health at work. Employers, as well as cooperatives, shall establish an OSH service at the workplace.
Pregnant workers and their partners shall not be dismissed from work by employers from the beginning of covennin pregnancy until two years after delivery. OSH legislation applies also to non-dependent workers whenever coveinn is compatible with the nature of their tasks. The employer, the contractor or the beneficiary employer, shall ensure the necessary training and publication of information related to the hazardous conditions of work, prior to initiating such work.
Employers shall prevent any harassment situation including the degradation of the work environment, physical or psychological violence, isolation or failure to provide a reasonable position to workers according to their abilities and background and shall avoid placing unjustified sanctions or criticisms on workers and their performance. Labour inspectorates have the power to impose financial penalties. Workers have the right to be reassigned to a different position due to health and rehabilitation reasons. Besides, the Organic Labour Law of May 7,sets out provisions concerning the work of children, pregnant and lactating workers, working conditions, and the Labour Inspectorate, among others. This 2327-89 will depend on the number of workers, the organization of labour, work shifts, areas, departments, location of the working spaces, as well as the danger of working processes. The worker shall inform the delegate or supervisor about this situation.
The main employer shall require contractors, subcontractors and intermediaries to comply with the duties established in OSH regulations. The OSH Committee shall be composed by an equal covfnin of representatives of workers and employers. The Budgetary Law for each budgetary year shall foresee a special provision for the promotion and prevention of occupational health and safety.
Domestic workers are expressly included within the scope of application of the Organic Law on Prevention, Working Conditions and Working Environment Art.
The activity shall resume when the OSH Committee determines so. Requirements for record keeping in relation to OSH committees are set out in the legislation. A joint committee on safety and health at work shall be established in every workplace, undertaking or working unit of any public and private entity.

For that purpose, delegates shall enter in any area thereof and communicate freely during the work day with workers without interrupting the normal development of the productive process. Time taken by the prevention OSH delegates to perform their duties and for training on OSH issues, shall be considered part of the working day and shall be paid.
Inspectors shall ensure the compliance with the standards of working conditions, health and safety at work, protection covvenin the family, motherhood and fatherhood, in all inspections within their territorial jurisdiction.
